Terms and Conditions of Dutch Sport Horse Sales

1. General
The foundation Dutch Sport Horse Sales (hereafter: DSHS), organises in its capacity of mediator between vendor and buyer on Wednesday 29th September 2010 the Dutch Sport Horse Sales (hereafter: auction) at the accommodation of Dressuur- & Springstal De IJzeren Man B.V. in Weert (NL). The auction will take place under the supervision of a notary.

2. Sales/Auction
During the auction the horses will be presented under the riders. The horses will be offered for sale in Euro by overbids, with a minimum upset price of € 10.000,00. A potential bidder/buyer will be kept to his/her last bid until a higher bid follows. If a knock down is assigned to a particular bidder/buyer by the auctioneer, then the bidder/buyer in question is obliged to fulfill the purchase price as calculated in article 3. Should any doubt arise as to the validity of the knock down the offer for sale can be resumed from the last bid. Any doubt regarding the validity of the knockdown can only be raised by the bidder, the auctioneer and the board of DSHS.

3. Payment of purchase price
Immediately after the auction the purchase price must be paid in the auctioneer’s office.
The purchase price will be calculated as follows:

Knock down price
6% commission charge +
1½% insurance + (optional)

Purchase price (inclusive 6% VAT, where applicable)

The purchase price is due immediately in cash or per cheque. It is possible to settle a payment arrangement beforehand with the board of DSHS. Any settlement of counter claims is excluded.
If required, DSHS is permitted to procure details concerning the financial situation of a particular bidder/buyer.
During the payment of the purchase price in the auctioneer’s office, the buyer will be offered the possibility to conclude an insurance for the horse bought. Such insurance will not be concluded by DSHS.

4. Horses at auction
The horses offered in the auction can be identified by pedigree, sex, colour and age, such as stated in the catalogue. DHSS takes no responsibility for and gives no guarantee regarding further characteristics such as performance, health or other qualities.

The horses that will be put up for auction have been X-rayed and clinically examined within the 3 months preceding the auction. The results of the veterinary examinations can be evaluated with the auction veterinarian preliminary to the auction. The evaluation of the X-rays and clinical examination, as well as the comments made thereupon, is the sole responsibility of Dr. E. Enzerink.

5. Removal, transfer of liability and ownership
Immediately after the knock down all responsibilities as well as all risk factors will be transferred to the buyer. Directly after fulfillment of the purchase price the legal ownership will also be transferred.
The horses, which stay at the accommodation of Dressuur- & Springstal De IJzeren Man B.V., must be removed from the accommodation within 24 hours of the payment of the purchase price and after transfer to the buyer. The costs, the responsibility and the risks of transport will be for the buyer.

6. Hidden deficiencies and stable vices
The buyer is permitted to withdraw from the purchase within 7 days after the auction if he/she discovers the horse purchased has hidden deficiencies and stable vices, such as wind-sucking and weaving. After the above-stated period all claim rights will expire.

Insurance

During the Dutch Sport Horse Sales 2010 an insurance agent will be present to offer you the possibility of insuring the horse(s) you have purchased. It is possible to insure the horse(s) for up to 13 days after the auction, with an option to extend. There is a choice of insurances offered.
